1.  What is a will?

A will is a legal document that is drafted and executed in accordance with state law.

2.  What does a will do?

A will names your beneficiaries, a guardian for your minor children, and an executor to supervise
the distribution of your property.  A will states your wishes as to how your property should be
distributed and to whom.

3.  Who needs a will?

Anyone who cares about what happens to their family and how their property will be distributed
after passing away needs a will.

4.  What happens if I don't have a will?

If you don't have a will, the law of your state determines who your beneficiaries are.  In such cases
where there is no will, a person dies
intestate and his/her living relatives will usually inherit his/her
property.  Furthermore, a court will decide and appoint a guardian for your minor children.

A will is significant to everyone, but more so for individuals in same-sex relationships who do not
reside in a state where same-sex marriages, civil unions, or domestic partnerships are legally
recognized.  Whereas in a heterosexual marriage, the surviving spouse inherits property and
assumes custody of minor children, the surviving partner in a same-sex relationship does not
stand to inherit property nor the minor children of the deceased partner unless it is clearly
outlined in a will.
